The agreement

These Terms are a legal agreement between you and ARCONI LTD. They establish a fair, reusable baseline for our games and related services. Product-specific rules shown before use or purchase form part of this agreement.

1. About these Terms

ARCONI LTD ("ARCONI", "we", "us", or "our") is registered in England and Wales under company number 16982238, with its registered office at 71–75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom.

These Terms of Service ("Terms") govern every ARCONI game, website, app, account, community, playtest, and related product or service that links to them (together, the "Services"). By using a Service, you agree to these Terms. If you do not agree, do not use it.

A Service may present additional product terms, rules, offer details, codes of conduct, tournament rules, marketplace rules, or platform requirements ("Service Rules"). They form part of these Terms. If there is a conflict, the more specific Service Rule controls for that feature.

2. Eligibility and younger players

You must meet the minimum age shown in the Service's store listing or Service Rules. If you are not old enough to enter this agreement where you live, a parent or legal guardian must review and agree to it for you. A parent or guardian who permits a child to use a Service is responsible for supervising that use, including purchases and communications.

You may not use a Service where prohibited by law, if you are subject to applicable trade restrictions, or if we have suspended you for a material breach and have not authorised your return.

3. Accounts and security

Some Services require an ARCONI or third-party account. Provide accurate information, keep credentials confidential, and promptly report suspected unauthorised access. You are responsible for account activity to the extent permitted by law.

Unless a Service expressly permits it, you may not sell, rent, gift, share, or transfer an account or access credential. We may require reasonable verification before restoring access, processing a sensitive request, or transferring an entitlement.

You may request closure of an ARCONI-managed account using an available in-Service control or by contacting [email protected]. Platform accounts must be managed with the platform provider.

4. Your licence to use the Services

Subject to these Terms and applicable Service Rules, we grant you a personal, limited, revocable, non-exclusive, non-transferable, and non-sublicensable licence to access and use the Services for your own non-commercial entertainment. The Services are licensed, not sold. We and our licensors reserve all rights not expressly granted.

You may make recordings, streams, screenshots, reviews, and fan content only as permitted by law, the relevant Service Rules, and any ARCONI fan-content policy then in effect. This permission does not allow you to imply endorsement, disclose confidential material, redistribute standalone assets, or commercially exploit the Services outside authorised programmes.

Platforms and storefronts may impose additional usage rules. If downloaded from Apple's App Store, Apple is not a party to these Terms and is not responsible for maintenance or support. To the extent required by Apple's terms, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the applicable App Store provisions.

5. Conduct and fair play

You must not, and must not help another person to:

  • cheat, collude, exploit bugs, manipulate matchmaking or rankings, or use unauthorised bots, scripts, automation, mods, hacks, emulators, or tools;
  • harass, threaten, stalk, impersonate, defraud, discriminate against, or expose personal information about another person;
  • submit content that is unlawful, infringing, hateful, sexually exploitative, deceptive, malicious, or seriously harmful;
  • disrupt a Service, attack or overload systems, bypass security or access controls, introduce malicious code, scrape data, or access accounts, systems, or data without permission;
  • reverse engineer, decompile, disassemble, copy, modify, distribute, sell, or commercially exploit a Service except where applicable law expressly permits it despite this restriction;
  • infringe intellectual property, privacy, publicity, contractual, or other rights;
  • trade accounts or Virtual Content outside an authorised feature, facilitate unauthorised real-money trading, chargebacks, money laundering, or fraud; or
  • use a Service for unlawful gambling, sanctions evasion, commercial solicitation, or any purpose outside the licence granted above.

Do not attempt to reproduce a bug or security issue beyond what is reasonably necessary to report it safely. Send vulnerability reports to [email protected].

6. Anti-cheat, moderation, and safety

To protect players and Service integrity, we may use automated and human review of gameplay, transactions, communications, reports, devices, and technical signals, as described in our Privacy Policy. We may preserve relevant evidence and cooperate with platforms or lawful authorities where appropriate.

Detection systems are not infallible. Where appropriate, we consider context, severity, history, and available evidence before taking action. A Service may provide an appeal route. Abuse of reporting or appeal systems is itself a violation.

7. User Content

"User Content" means anything you submit or create through a Service, including names, messages, voice, images, recordings, maps, mods, designs, and feedback. You retain rights you already hold. You must have the necessary rights and permissions, and your content must comply with these Terms.

You grant ARCONI a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt, format, communicate, display, distribute, and moderate User Content as reasonably necessary to operate, provide, secure, promote, and improve the Services. This licence lasts while the content is used by the Services, subject to reasonable backup periods and rights already granted to other users through a feature.

Where a Service lets you delete User Content, the licence ends for future use after deletion, except where continued use is reasonably necessary for safety, legal compliance, dispute resolution, technical operation, or content incorporated into a shared creation. We do not guarantee that User Content will be stored indefinitely.

Feedback may be used without restriction, confidentiality obligation, or payment. Do not submit confidential information as feedback.

8. Prices, purchases, and refunds

A Service may offer paid games, add-ons, downloadable content, bundles, subscriptions, virtual currency, virtual items, or other digital content. Before purchase, the applicable offer or checkout will show the price, currency, mandatory charges, material restrictions, and other information required by law.

Purchases made through a platform or storefront are billed by that provider and ordinarily follow its payment and refund processes. Purchases made directly from ARCONI follow the terms shown at checkout. You are responsible for applicable taxes unless the price states they are included.

Do not initiate a chargeback for a valid purchase without first using the available support or refund process. We may restrict associated content while a payment dispute is investigated, but nothing here limits a statutory refund, cancellation, quality, or conformity right that cannot lawfully be excluded.

9. Subscriptions

A subscription's price, billing period, benefits, trial or introductory period, renewal terms, minimum commitment, and cancellation method will be shown before you subscribe. Unless stated otherwise, subscriptions renew automatically until cancelled.

You may cancel through the platform or account settings identified at purchase. Cancellation ordinarily stops future renewal while access continues through the paid period. We will provide renewal reminders, cooling-off rights, straightforward cancellation, and refunds where required by applicable law. A price change takes effect only after the notice and consent required by law.

10. Virtual Content and economies

"Virtual Content" includes virtual currency, items, cosmetics, boosts, entitlements, and other digital benefits. Unless Service Rules expressly say otherwise, Virtual Content is a limited licence for use only in the relevant Service. It is not legal tender or property, has no cash value, and cannot be redeemed for money except where law requires.

We may add, rebalance, limit, or retire Virtual Content for valid gameplay, security, legal, technical, or commercial reasons. We will act reasonably, provide notice where appropriate, and respect mandatory consumer rights. Unauthorised acquisition, duplication, sale, or transfer may be reversed.

11. Trading and marketplaces

A Service may permit gifts, trades, auctions, creator sales, or marketplace transactions through features we authorise. Service Rules may set eligibility, fees, royalties, price limits, settlement periods, transfer restrictions, taxes, reversals, and fraud controls.

Trades carry risk. Check the item and terms before confirming. Unless law or Service Rules require otherwise, completed authorised trades are final. We may delay, cancel, reverse, or restrict a transaction reasonably suspected of fraud, mistake, abuse, sanctions violations, or technical failure.

Off-platform transactions are not authorised or protected by ARCONI. We are not responsible for promises, payments, or losses arising from them, except where responsibility cannot lawfully be excluded.

12. Advertising, promotions, and rewards

Services may contain contextual or personalised advertising, sponsorships, product placements, referral programmes, or optional rewarded ads. Advertising and privacy choices are explained in the relevant Service and our Privacy Policy.

A promotion, contest, sweepstake, tournament, or referral programme may have separate official rules covering eligibility, territories, dates, judging, prizes, taxes, and disqualification. Those rules control that promotion. Rewards obtained through fraud, automation, or technical error may be withheld or reversed.

13. Tests, betas, and previews

Pre-release Services may be incomplete, unstable, confidential, subject to reset, and changed or withdrawn without notice. Progress, items, or access may not carry into release. If a test is confidential, you must not disclose its content, recordings, access credentials, or feedback except as permitted in writing.

14. ARCONI content and intellectual property

The Services—including software, characters, artwork, music, stories, designs, databases, trademarks, and other content—are owned by or licensed to ARCONI and protected by intellectual-property laws. ARCONI names, logos, and marks may not be used without permission.

If you believe content in a Service infringes your rights, contact us with your contact details, identification of the work and disputed content, its location, the basis of your claim, and a statement that the information is accurate and you are authorised to act.

15. Updates, availability, and changes

Games and online services evolve. We may provide patches, updates, new features, balance changes, security fixes, or compatibility changes. An update may be required to continue using a Service.

We may change or discontinue features for valid operational, technical, security, legal, or commercial reasons. We do not promise that every Service or online feature will always be available. Where a change materially reduces paid content, we will provide reasonable notice where practicable and any remedy required by law.

16. Suspension, termination, and appeals

You may stop using a Service at any time. We may warn, remove content, reset progress or transactions, restrict features, suspend, or terminate access where you materially or repeatedly breach these Terms; where reasonably necessary to protect players, ARCONI, or others; to address fraud or security risk; or to comply with law or platform requirements.

We aim for proportionate action and may act immediately where the risk is serious. Where an appeal is available, follow the instructions in the notice or contact support. Continuing to evade a restriction may lead to further action.

When access ends, your licence ends. Provisions that by nature should continue—including ownership, accrued payments, disclaimers, liability, and dispute provisions—survive. Termination does not remove mandatory consumer rights or rights that arose before termination.

17. Third-party services

A Service may link to or interoperate with platforms, stores, payment providers, social networks, marketplaces, websites, or content controlled by others. Their terms and privacy policies apply. We are not responsible for third-party services we do not control, except where responsibility cannot lawfully be excluded.

18. Service standards, disclaimers, and liability

We will provide consumer Services with reasonable care and skill. Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or mandatory consumer rights.

If you are a consumer, we are responsible for foreseeable loss caused by our breach of these Terms or failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable, business loss arising from consumer use, or loss caused by your breach, an event outside our reasonable control, or a third-party service we do not control.

To the fullest extent permitted by law, we do not guarantee uninterrupted or error-free operation, permanent availability of online features or User Content, or compatibility with every device, network, modification, or third-party service.

If you use a Service for business purposes, ARCONI is not liable for indirect or consequential loss or loss of profit, revenue, business, opportunity, goodwill, or data. Our aggregate liability arising from the affected Service will not exceed the greater of £100 and the amount you paid ARCONI for that Service during the 12 months before the event giving rise to the claim.

19. Governing law and disputes

Contact [email protected] first so we can try to resolve a concern informally. Nothing in this section prevents either party seeking urgent relief or using a regulator, court, or alternative dispute process available by law.

These Terms are governed by the laws of England and Wales. If you are a consumer, this choice does not deprive you of mandatory protections under the law of your home country. The courts of England and Wales have non-exclusive jurisdiction; consumers may also bring proceedings in courts available under applicable law.

20. Changes to these Terms

We may update these Terms for valid reasons such as changes to a Service, law, security, technology, or our business. We will post the updated Terms and revise the date above. Material changes will receive reasonable additional notice before taking effect where required. Changes do not apply retroactively. If you do not accept an update, stop using the affected Service before it takes effect.

21. General

These Terms and applicable Service Rules are the agreement between you and us about the Services. If a provision is unlawful or unenforceable, it will be adjusted only as necessary or removed, and the rest will continue. A delay in enforcement is not a waiver.

You may not transfer your rights or obligations without our consent. We may transfer ours as part of a reorganisation, financing, or sale, provided this does not reduce mandatory rights. No person other than you, ARCONI, and a platform beneficiary expressly identified in these Terms has a right to enforce them.
